Elder Law

Sooner or later, we all face the reality of our own mortality, and the longer we live, the more likely it is that our mind and body will suffer from deterioration or a traumatic event that causes us to lose the capacity to make our own health care decisions.  Don't wait until it's too late.  Do something about it now.  Robert W. Tribuiani, Esq., an attorney at law, can help you plan for your senior years so that you can live your life to its fullest, knowing that you have saved your loved ones from costly delays down the road.   Contact us for a legal consultation so we can help you plan for your senior years now.

Medicaid

Medicaid is intended to provide medical assistance to the elderly, blind, and disabled poor.  In order to qualify for Medicaid, the applicant must meet at least three criteria:
  1. the applicant must require skilled nursing service and be a resident of, or have a move-in date at, a skilled nursing facility approved by Medicaid.
  2. the applicant's income cannot exceed $2,022 per month.
  3. the applicant's countable assets cannot exceed $2,000, and the applicant's spouse's countable assets cannot exceed $109,560.
Through the use of exempted transfers, qualified income trusts, personal service contracts, special needs trusts, and other estate planning techniques the Tribuiani Law Firm can help you qualify for Medicaid, regardless of your current financial status.  Please contact Robert W. Tribuiani, Esq., for an up-to-date road map of the legal and financial issues you will face in becoming qualified for Medicaid.

Medicare

Medicare is intended to provide medical coverage for the elderly, disabled, and those with end stage renal disease.  Medicare is divided into Parts A, B, C, and D, as follows:
  • Part A: usually provided to those with a qualifying number of quarters of employment, but is also available to others who pay a premium.  It covers skilled nursing home facilities and hospitals.
  • Part B: usually provided to those who pay a premium.  It covers outpatient care, therapy, and home care.
  • Part C: combination of Parts A and B, and is provided through private insurance companies.
  • Part D: prescription drug insurance for which most people have to pay a premium.  It covers prescription drugs.
